We are delighted by your interest in our company. Data protection is of particularly high importance to the management of Roth & Stuhl GmbH. It is generally possible to use the Roth & Stuhl GmbH websites without providing any personal data. However, if a data subject wishes to use special services of our company via our website, processing of personal data may become necessary. If the processing of personal data is necessary and there is no legal basis for such processing, we generally obtain the data subject's consent.

The processing of personal data, such as the name, address, email address, or telephone number of a data subject, always takes place in accordance with the General Data Protection Regulation and in compliance with the country-specific data protection regulations applicable to Roth & Stuhl GmbH. Through this privacy policy, our company wishes to inform the public about the nature, scope, and purpose of the personal data we collect, use, and process. Furthermore, data subjects are informed of their rights by means of this privacy policy.

As the controller responsible for processing, Roth & Stuhl GmbH has implemented numerous technical and organizational measures to ensure the most complete protection possible of personal data processed via this website. Nevertheless, internet-based data transmissions can, in principle, have security vulnerabilities, so absolute protection cannot be guaranteed. For this reason, every data subject is free to transmit personal data to us via alternative means, for example, by telephone.

3. Cookies

The websites of Roth & Stuhl GmbH use cookies. Cookies are text files that are stored and saved on a computer system via an internet browser.

Numerous websites and servers use cookies. Many cookies contain a so-called cookie ID. A cookie ID is a unique identifier of the cookie. It consists of a character string through which websites and servers can be assigned to the specific internet browser in which the cookie was stored. This enables the visited websites and servers to distinguish the individual browser of the data subject from other internet browsers that contain other cookies. A specific internet browser can be recognized and identified via the unique cookie ID.

Through the use of cookies, Roth & Stuhl GmbH can provide users of this website with more user-friendly services that would not be possible without the cookie setting.

By means of a cookie, the information and offers on our website can be optimized in the user's interest. Cookies enable us, as already mentioned, to recognize the users of our website. The purpose of this recognition is to make it easier for users to use our website. For example, the user of a website that uses cookies does not have to re-enter their access data each time they visit the website, because this is done by the website and the cookie stored on the user's computer system. Another example is the cookie of a shopping cart in the online shop. The online shop remembers the items that a customer has placed in the virtual shopping cart via a cookie.

The data subject can prevent the setting of cookies by our website at any time by means of a corresponding setting of the internet browser used and thus permanently object to the setting of cookies. Furthermore, already set cookies can be deleted at any time via an internet browser or other software programs. This is possible in all common internet browsers. If the data subject deactivates the setting of cookies in the internet browser used, not all functions of our website may be fully usable.

4. Collection of general data and information

The Roth & Stuhl GmbH website collects a series of general data and information with each call of the website by a data subject or an automated system. This general data and information is stored in the log files of the server. The following can be recorded: (1) the browser types and versions used, (2) the operating system used by the accessing system, (3) the website from which an accessing system reaches our website (so-called referrers), (4) the sub-websites that are accessed on our website via an accessing system, (5) the date and time of an access to the website, (6) an Internet Protocol address (IP address), (7) the Internet service provider of the accessing system and (8) other similar data and information that serves to avert danger in the event of attacks on our information technology systems.

When using this general data and information, Roth & Stuhl GmbH does not draw any conclusions about the data subject. Rather, this information is needed to (1) deliver the content of our website correctly, (2) optimize the content of our website as well as the advertising for it, (3) ensure the permanent functionality of our information technology systems and the technology of our website, and (4) to provide law enforcement authorities with the information necessary for prosecution in the event of a cyberattack. Therefore, Roth & Stuhl GmbH evaluates this anonymously collected data and information statistically and furthermore with the aim of increasing data protection and data security in our company, ultimately to ensure an optimal level of protection for the personal data we process. The anonymous data of the server log files are stored separately from all personal data provided by a data subject.

5. Registration on our website

The data subject has the option to register on the website of the controller by providing personal data. Which personal data is transmitted to the controller is determined by the respective input mask used for registration. The personal data entered by the data subject is collected and stored exclusively for internal use by the controller and for their own purposes. The controller may arrange for the transfer to one or more processors, for example, a parcel service provider, who also uses the personal data exclusively for internal use attributable to the controller.

By registering on the website of the controller, the IP address assigned by the data subject's Internet service provider (ISP), the date, and time of registration are also stored. This data is stored against the background that only in this way can the misuse of our services be prevented, and this data, if necessary, enables the investigation of committed criminal offenses. In this respect, the storage of this data is necessary to secure the controller. As a matter of principle, this data is not passed on to third parties, unless there is a legal obligation to pass it on or the passing on serves the purpose of criminal prosecution.

The registration of the data subject with the voluntary provision of personal data serves the controller to offer the data subject content or services that, due to the nature of the matter, can only be offered to registered users. Registered persons have the option to change the personal data provided during registration at any time or to have it completely deleted from the data stock of the controller.

The controller provides any data subject with information at any time upon request about what personal data is stored about the data subject. Furthermore, the controller corrects or deletes personal data at the request or instruction of the data subject, as long as there are no legal retention obligations to the contrary. All employees of the controller are available to the data subject as contact persons in this context.

6. Subscription to our newsletter

On the Roth & Stuhl GmbH website, users are given the opportunity to subscribe to our company's newsletter. Which personal data is transmitted to the controller when ordering the newsletter is determined by the input mask used for this purpose.

Roth & Stuhl GmbH informs its customers and business partners at regular intervals about company offers by means of a newsletter. The newsletter of our company can generally only be received by the data subject if (1) the data subject has a valid email address and (2) the data subject registers for the newsletter dispatch. For legal reasons, a confirmation email is sent to the email address entered by a data subject for the first time for newsletter dispatch using the double opt-in procedure. This confirmation email serves to verify whether the owner of the email address as the data subject has authorized the receipt of the newsletter.

When registering for the newsletter, we also store the IP address assigned by the Internet service provider (ISP) of the computer system used by the data subject at the time of registration, as well as the date and time of registration. The collection of this data is necessary to be able to trace the (possible) misuse of a data subject's email address at a later date and therefore serves to legally protect the controller.

The personal data collected within the scope of a newsletter registration is used exclusively for sending our newsletter. Furthermore, newsletter subscribers could be informed by email if this is necessary for the operation of the newsletter service or a corresponding registration, as might be the case in the event of changes to the newsletter offer or changes in technical conditions. No personal data collected within the scope of the newsletter service is passed on to third parties. The subscription to our newsletter can be canceled by the data subject at any time. The consent to the storage of personal data that the data subject has given us for newsletter dispatch can be revoked at any time. A corresponding link for revoking consent can be found in every newsletter. Furthermore, it is possible to unsubscribe from newsletter dispatch directly on the controller's website at any time or to inform the controller in another way.

7. Newsletter tracking

The newsletters of Roth & Stuhl GmbH contain so-called tracking pixels. A tracking pixel is a miniature graphic embedded in such emails that are sent in HTML format to enable log file recording and log file analysis. This allows for a statistical evaluation of the success or failure of online marketing campaigns. Based on the embedded tracking pixel, Roth & Stuhl GmbH can recognize whether and when an email was opened by a data subject and which links in the email were accessed by the data subject.

Such personal data collected via the tracking pixels contained in the newsletters are stored and evaluated by the controller to optimize newsletter dispatch and to better adapt the content of future newsletters to the interests of the data subject. This personal data is not passed on to third parties. Data subjects are entitled at any time to revoke the separate consent declaration given via the double opt-in procedure. After revocation, this personal data will be deleted by the controller. Unsubscribing from the newsletter is automatically interpreted by Roth & Stuhl GmbH as a revocation.

8. Contact possibility via the website

The website of Roth & Stuhl GmbH contains, due to legal regulations, information that enables quick electronic contact with our company as well as direct communication with us, which also includes a general address of the so-called electronic mail (email address). If a data subject contacts the controller by email or via a contact form, the personal data transmitted by the data subject is automatically stored. Such personal data voluntarily transmitted by a data subject to the controller is stored for the purpose of processing or contacting the data subject. This personal data is not passed on to third parties.

9. Routine deletion and blocking of personal data

The controller processes and stores personal data of the data subject only for the period necessary to achieve the storage purpose or if this has been provided for by the European legislator or another legislator in laws or regulations to which the controller is subject.

If the storage purpose ceases to apply or if a storage period prescribed by the European legislator or another competent legislator expires, the personal data will be routinely blocked or deleted in accordance with legal provisions.

a) Right to confirmation

b) Right to information

c) Right to rectification

e) Right to restriction of processing

f) Right to data portability

h) Automated individual decision-making, including profiling

i) Right to withdraw data protection consent

11. Data protection provisions on the use and application of Google Analytics (with anonymization function)

The controller has integrated the Google Analytics component (with anonymization function) on this website. Google Analytics is a web analysis service. Web analysis is the collection, gathering and evaluation of data about the behavior of visitors to websites. A web analysis service collects, among other things, data on which website a data subject has come from to a website (so-called referrers), which subpages of the website have been accessed or how often and for what period of time a subpage has been viewed. A web analysis is mainly used to optimize a website and for the cost-benefit analysis of internet advertising.

The operating company of the Google Analytics component is Google Ireland Limited, Gordon House, Barrow Street, Dublin, D04 E5W5, Ireland.

The controller uses the "_gat._anonymizeIp" add-on for web analysis via Google Analytics. By means of this add-on, the IP address of the data subject's Internet connection is shortened and anonymized by Google if access to our websites takes place from a member state of the European Union or from another contracting state to the Agreement on the European Economic Area.

The purpose of the Google Analytics component is to analyze the flow of visitors to our website. Google uses the data and information obtained, among other things, to evaluate the use of our website, to compile online reports for us that show the activities on our websites, and to provide other services related to the use of our website.

Google Analytics places a cookie on the information technology system of the data subject. What cookies are has already been explained above. By setting the cookie, Google is enabled to analyze the use of our website. With each call of one of the individual pages of this website, which is operated by the controller and on which a Google Analytics component has been integrated, the internet browser on the information technology system of the data subject is automatically prompted by the respective Google Analytics component to transmit data to Google for the purpose of online analysis. As part of this technical process, Google gains knowledge of personal data, such as the IP address of the data subject, which Google uses, among other things, to track the origin of visitors and clicks and subsequently enable commission settlements.

Through the use of cookies, personal information such as the time of access, the location from which access originated, and the frequency of visits to our website by the data subject are stored. Each time our website is visited, this personal data, including the IP address of the internet connection used by the data subject, is transmitted to Google in the United States of America. This personal data is stored by Google in the United States of America. Google may disclose this personal data collected through the technical process to third parties.

The data subject can prevent the setting of cookies by our website at any time, as described above, by means of a corresponding setting of the internet browser used, and thus permanently object to the setting of cookies. Such a setting of the internet browser used would also prevent Google from setting a cookie on the data subject's information technology system. In addition, a cookie already set by Google Analytics can be deleted at any time via the internet browser or other software programs.

Furthermore, the data subject has the option to object to and prevent the collection of data generated by Google Analytics related to the use of this website, as well as the processing of this data by Google. To do this, the data subject must download and install a browser add-on from the link https://tools.google.com/dlpage/gaoptout. This browser add-on informs Google Analytics via JavaScript that no data and information about website visits may be transmitted to Google Analytics. The installation of the browser add-on is considered an objection by Google. If the data subject's information technology system is deleted, formatted, or reinstalled at a later time, the data subject must reinstall the browser add-on to deactivate Google Analytics. If the browser add-on is uninstalled or deactivated by the data subject or another person attributable to their sphere of influence, it is possible to reinstall or reactivate the browser add-on.

Further information and Google's current data protection provisions can be accessed at https://www.google.de/intl/de/policies/privacy/ and at http://www.google.com/analytics/terms/de.html. Google Analytics is explained in more detail at this link https://www.google.com/intl/de_de/analytics/.

12. Data protection provisions regarding the use of Instagram

The controller has integrated Instagram components on this website. Instagram is a service that can be classified as an audiovisual platform and enables users to share photos and videos, and also to redistribute such data in other social networks.

The operating company of Instagram's services is Facebook Ireland Ltd., 4 Grand Canal Square, Grand Canal Harbour, Dublin 2 Ireland.

With each call of one of the individual pages of this website, which is operated by the controller and on which an Instagram component (Insta-Button) has been integrated, the internet browser on the data subject's information technology system is automatically prompted by the respective Instagram component to download a display of the corresponding Instagram component. Within the scope of this technical procedure, Instagram gains knowledge of which specific sub-page of our website is visited by the data subject.

If the data subject is logged into Instagram simultaneously, Instagram recognizes, with each call of our website by the data subject and for the entire duration of their respective stay on our website, which specific sub-page the data subject visits. This information is collected by the Instagram component and assigned by Instagram to the data subject's respective Instagram account. If the data subject clicks on one of the Instagram buttons integrated on our website, the data and information thus transmitted are assigned to the data subject's personal Instagram user account and stored and processed by Instagram.

Instagram always receives information via the Instagram component that the data subject has visited our website if the data subject is simultaneously logged into Instagram at the time of accessing our website; this takes place regardless of whether the data subject clicks on the Instagram component or not. If the data subject does not wish for such a transmission of this information to Instagram, they can prevent the transmission by logging out of their Instagram account before accessing our website.

Further information and the current data protection provisions of Instagram can be accessed at https://help.instagram.com/155833707900388 and https://www.instagram.com/about/legal/privacy/.

13. Data protection provisions regarding the use of YouTube

The controller has integrated YouTube components on this website. YouTube is an internet video portal that allows video publishers to upload video clips free of charge and other users to view, rate, and comment on them free of charge. YouTube allows the publication of all types of videos, which means that full-length films and television shows, as well as music videos, trailers, or videos created by users themselves, can be accessed via the internet portal.

The operating company of YouTube is Google Ireland Limited, Gordon House, Barrow Street, Dublin, D04 E5W5, Ireland.

With each call of one of the individual pages of this website, which is operated by the controller and on which a YouTube component (YouTube video) has been integrated, the internet browser on the data subject's information technology system is automatically prompted by the respective YouTube component to download a display of the corresponding YouTube component from YouTube. Further information about YouTube can be accessed at https://www.youtube.com/yt/about/de/. Within the scope of this technical procedure, YouTube and Google gain knowledge of which specific sub-page of our website is visited by the data subject.

If the data subject is logged into YouTube simultaneously, YouTube recognizes, when a sub-page containing a YouTube video is accessed, which specific sub-page of our website the data subject visits. This information is collected by YouTube and Google and assigned to the data subject's respective YouTube account.

YouTube and Google always receive information via the YouTube component that the data subject has visited our website if the data subject is simultaneously logged into YouTube at the time of accessing our website; this takes place regardless of whether the data subject clicks on a YouTube video or not. If the data subject does not wish for such a transmission of this information to YouTube and Google, they can prevent the transmission by logging out of their YouTube account before accessing our website.

The data protection provisions published by YouTube, which can be accessed at https://www.google.de/intl/de/policies/privacy/, provide information about the collection, processing, and use of personal data by YouTube and Google.

The operating company of Klarna is Klarna Bank AB, Sveavägen 46, 111 34 Stockholm, Sweden.

If the data subject selects either "purchase on account" or "installment purchase" as the payment option during the ordering process in our online shop, the data subject's data is automatically transmitted to Klarna. Klarna also shares personal data with affiliated companies (Klarna Group) and service providers or subcontractors insofar as this is necessary to fulfill contractual obligations or if the data is to be processed on commission.

To decide on the establishment, execution, or termination of a contractual relationship, Klarna collects and uses data and information about the data subject's past payment behavior as well as probability values for their future behavior (so-called scoring). The calculation of the scoring is carried out on the basis of scientifically recognized mathematical-statistical procedures.

The data subject has the option to revoke their consent to the handling of personal data at any time vis-à-vis Klarna. A revocation does not affect personal data that must be processed, used, or transmitted for the (contractual) payment processing.

Klarna's current data protection provisions can be accessed at https://cdn.klarna.com/1.0/shared/content/policy/data/de_de/data_protection.pdf.

15. Payment method: Data protection provisions for PayPal as a payment method

The controller has integrated PayPal components on this website. PayPal is an online payment service provider. Payments are processed via so-called PayPal accounts, which represent virtual private or business accounts. In addition, PayPal offers the possibility to process virtual payments via credit cards if a user does not have a PayPal account. A PayPal account is managed via an email address, which is why there is no classic account number. PayPal enables online payments to third parties or to receive payments. PayPal also takes on trustee functions and offers buyer protection services.

The European operating company of PayPal is PayPal (Europe) S.à.r.l. et Cie, S.C.A., 22-24 Boulevard Royal L-2449, Luxembourg.

If the data subject selects "PayPal" as the payment option during the ordering process in our online shop, the data subject's data is automatically transmitted to PayPal. By selecting this payment option, the data subject consents to the transmission of personal data necessary for payment processing.

The personal data transmitted to PayPal usually includes first name, last name, address, email address, IP address, telephone number, mobile phone number, or other data necessary for payment processing. Personal data related to the respective order are also necessary for the processing of the purchase contract.

The purpose of the data transmission is payment processing and fraud prevention. The personal data exchanged between PayPal and the controller may be transmitted by PayPal to credit agencies. This transmission serves the purpose of identity and credit checks.

PayPal may disclose personal data to affiliated companies and service providers or subcontractors insofar as this is necessary to fulfill contractual obligations or if the data is to be processed on commission.

The data subject has the option to revoke their consent to the handling of personal data at any time vis-à-vis PayPal. A revocation does not affect personal data that must be processed, used, or transmitted for the (contractual) payment processing.

PayPal's current data protection provisions can be accessed at https://www.paypal.com/de/webapps/mpp/ua/privacy-full.

16. Legal basis for processing

Art. 6 I lit. a GDPR serves as the legal basis for processing operations for our company where we obtain consent for a specific processing purpose. If the processing of personal data is necessary for the performance of a contract to which the data subject is party, as is the case, for example, with processing operations that are necessary for the delivery of goods or the provision of another service or consideration, the processing is based on Art. 6 I lit. b GDPR. The same applies to such processing operations that are necessary for carrying out pre-contractual measures, for example in cases of inquiries about our products or services. If our company is subject to a legal obligation by which the processing of personal data becomes necessary, such as for the fulfillment of tax obligations, the processing is based on Art. 6 I lit. c GDPR. In rare cases, the processing of personal data might be necessary to protect the vital interests of the data subject or another natural person. This would be the case, for example, if a visitor were injured in our company and their name, age, health insurance data, or other vital information had to be passed on to a doctor, hospital, or other third party. Then the processing would be based on Art. 6 I lit. d GDPR.
Finally, processing operations could be based on Art. 6 I lit. f GDPR. Processing operations that are not covered by any of the aforementioned legal bases are based on this legal basis if the processing is necessary for the purposes of the legitimate interests pursued by our company or by a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject. Such processing operations are particularly permissible for us because they have been specifically mentioned by the European legislator. In this respect, he was of the opinion that a legitimate interest could be assumed if the data subject is a customer of the controller (Recital 47 Sentence 2 GDPR).

17. Legitimate interests in processing pursued by the controller or a third party

If the processing of personal data is based on Article 6 I lit. f GDPR, our legitimate interest is the performance of our business activities for the well-being of all our employees and shareholders.

18. Duration for which personal data is stored

The criterion for the duration of storage of personal data is the respective statutory retention period. After the expiry of the period, the corresponding data is routinely deleted, provided that it is no longer necessary for contract fulfillment or contract initiation.

19. Statutory or contractual provisions for the provision of personal data; necessity for the conclusion of the contract; obligation of the data subject to provide the personal data; possible consequences of non-provision

We inform you that the provision of personal data is partly required by law (e.g. tax regulations) or may also result from contractual regulations (e.g. information on the contractual partner).
Sometimes it may be necessary for the conclusion of a contract that a data subject provides us with personal data that subsequently must be processed by us. The data subject is, for example, obliged to provide us with personal data if our company concludes a contract with them. Non-provision of the personal data would mean that the contract with the data subject could not be concluded.
Before providing personal data, the data subject must contact one of our employees. Our employee will inform the data subject on a case-by-case basis whether the provision of the personal data is legally or contractually required or necessary for the conclusion of the contract, whether there is an obligation to provide the personal data, and what consequences the non-provision of the personal data would have.

20. Existence of automated decision-making

As a responsible company, we do not use automated decision-making or profiling.

This data protection declaration was created by the data protection declaration generator of DGD Deutsche Gesellschaft für Datenschutz GmbH, which acts as an external data protection officer in Middle Franconia, in cooperation with the data protection lawyers of the law firm WILDE BEUGER SOLMECKE | Rechtsanwälte.
